🇬🇧 General Terms and Conditions (EN)

1. General Information

(1) These General Terms and Conditions apply to all orders placed via the online store www.finalsaga.de.

(2) Any deviating terms and conditions of the customer shall not apply unless expressly agreed to in writing.

(3) Individual agreements between the parties take precedence over these Terms and Conditions.

2. Conclusion of Contract

(1) Product presentations in the online store do not constitute a legally binding offer but an invitation to place an order.

(2) By placing an order, the customer submits a binding offer to conclude a purchase contract.

(3) After submitting the order, the customer receives an automatic order confirmation. This confirmation does not yet constitute acceptance of the contract.

(4) The contract is concluded only upon shipment confirmation or delivery of the goods.

3. Applicable Law

The contractual relationship is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers residing outside Germany, mandatory consumer protection provisions of their country of residence remain unaffected.

4. Prices, Payment and Shipping

(1) All prices include statutory VAT where applicable.

(2) Available payment methods include:
Apple Pay, Google Pay, credit card, prepayment, Giropay, Paydirekt, PayPal.

(3) We deliver within Germany and internationally.

(4) Shipping is carried out via logistics providers such as DHL, UPS, or comparable services.

(5) Shipping costs are shown during checkout.

(6) Delivery times depend on destination and shipping method.

5. Shipping and Unclaimed Shipments

(1) The customer is responsible for providing a correct delivery address.

(2) If delivery fails due to incorrect address, absence, or non-collection, the customer is responsible for arranging redelivery or pickup within the carrier’s deadlines.

(3) Unclaimed shipments returned to us are treated as a customer-initiated return.

(4) Shipping costs are non-refundable. Additional return shipping fees and carrier charges may be deducted.

(5) Refunds are only issued after receipt and inspection of returned goods.

6. Returns

(1) Goods should preferably be returned in original packaging.

(2) The customer bears return shipping costs unless the return is due to our error or a defective product.

7. Retention of Title

Goods remain our property until full payment has been received.

If the customer is in default of payment, we are entitled to reclaim the goods.

8. Transport Damage

Visible transport damage should be reported immediately to the carrier.

Customers are also requested to notify us without delay.

Failure to report does not affect statutory rights but helps with carrier claims.

9. Liability

We are fully liable in cases of:

  • intent or gross negligence
  • injury to life, body or health
  • guaranteed characteristics
  • liability under product liability law

In cases of slight negligence, liability is limited to foreseeable damages typical for the contract and only for essential contractual obligations.

Further liability is excluded to the extent permitted by law.

10. Warranty Rights

(1) Statutory warranty rights apply.

(2) In case of defects, the customer may request repair or replacement.

(3) Warranty does not apply if defects are caused by improper use, external influence, unauthorized modification, or normal wear and tear.

(4) If repair or replacement fails, the customer may withdraw from the contract or request a price reduction.

(5) Statutory warranty period is two years from delivery.

11. Dispute Resolution

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

🇩🇪 Allgemeine Geschäftsbedingungen (DE)

1. Allgemeine Hinweise

(1) Diese Allgemeinen Geschäftsbedingungen gelten für alle Bestellungen über www.finalsaga.de.

(2) Abweichende Bedingungen des Kunden gelten nicht, sofern sie nicht ausdrücklich schriftlich vereinbart wurden.

(3) Individuelle Vereinbarungen haben Vorrang vor diesen AGB.

2. Vertragsschluss

(1) Die Darstellung der Produkte stellt kein rechtlich bindendes Angebot dar, sondern eine Aufforderung zur Bestellung.

(2) Mit Absenden der Bestellung gibt der Kunde ein verbindliches Angebot ab.

(3) Der Kunde erhält eine automatische Bestellbestätigung. Diese stellt noch keine Vertragsannahme dar.

(4) Der Vertrag kommt erst mit Versandbestätigung oder Lieferung zustande.

3. Anwendbares Recht

Es gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des UN-Kaufrechts (CISG).

Für Verbraucher im Ausland gelten zwingende Verbraucherschutzvorschriften ihres Wohnsitzstaates weiterhin.

4. Preise, Zahlung und Versand

(1) Alle Preise enthalten die gesetzliche Mehrwertsteuer.

(2) Zahlungsarten: Apple Pay, Google Pay, Kreditkarte, Vorkasse, Giropay, Paydirekt, PayPal.

(3) Lieferung erfolgt national und international.

(4) Versand erfolgt über DHL, UPS oder vergleichbare Dienstleister.

(5) Versandkosten werden im Checkout angezeigt.

(6) Lieferzeiten richten sich nach Zielort und Versandart.

5. Versand und nicht abgeholte Sendungen

(1) Der Kunde ist für eine korrekte Lieferadresse verantwortlich.

(2) Bei Nichtzustellung oder Nichtabholung trägt der Kunde Verantwortung für erneute Zustellung oder Abholung.

(3) Nicht abgeholte und zurückgesendete Sendungen gelten als Rücksendung durch den Kunden.

(4) Versandkosten werden nicht erstattet. Rücksendekosten und Gebühren können abgezogen werden.

(5) Rückerstattung erfolgt erst nach Rückerhalt und Prüfung der Ware.

6. Rücksendungen

(1) Ware sollte möglichst in Originalverpackung zurückgesendet werden.

(2) Rücksendekosten trägt der Kunde, sofern kein Mangel oder unser Fehler vorliegt.

7. Eigentumsvorbehalt

Die Ware bleibt bis zur vollständigen Zahlung unser Eigentum.

Bei Zahlungsverzug sind wir zur Rücknahme berechtigt.

8. Transportschäden

Offensichtliche Transportschäden sind sofort beim Zusteller zu melden.

Zusätzlich sollte eine Information an uns erfolgen.

9. Haftung

Unbeschränkte Haftung besteht bei:

  • Vorsatz oder grober Fahrlässigkeit
  • Verletzung von Leben, Körper oder Gesundheit
  • Garantien
  • Produkthaftung

Bei leichter Fahrlässigkeit nur bei wesentlichen Vertragspflichten und beschränkt auf vorhersehbare Schäden.

Weitergehende Haftung ist ausgeschlossen.

10. Gewährleistung

(1) Es gelten die gesetzlichen Gewährleistungsrechte.

(2) Bei Mängeln besteht Anspruch auf Nacherfüllung (Reparatur oder Ersatz).

(3) Kein Anspruch bei unsachgemäßer Nutzung, Fremdeinwirkung, eigenmächtigen Änderungen oder normalem Verschleiß.

(4) Bei Fehlschlagen der Nacherfüllung: Rücktritt oder Minderung möglich.

(5) Gewährleistungsfrist: 2 Jahre ab Lieferung.

11. Streitbeilegung

Wir sind nicht verpflichtet und nicht bereit, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
